We understand how important your personal information is for you, so we keep it as important for us. The use of your information has been outlined in our Privacy Policy. When you use our services, you allow us to use your information in a way according to our privacy policy that can be read here.

EU law held Tech Place and sellers as individual and separate data controllers, however, both are responsible for a safe processing of buyers personal information whenever they provide services. Both shares the same personal information of members for example delivery addresses, phone numbers, email addresses, delivery addresses, etc. The term of separate data controllers means Tech Place cannot be held responsible if an individual seller leaks out the personal details like an email address or phone number of a member while processing an order for a different buyer.

On the other hand, if somewhere in law, Tech Place and sellers considered being jointly responsible for the safe custody of buyer’s personal information, EU law gives some compensation rights to Tech Place. Let’s say, Tech Place faces a sue for the breach of the privacy policy by an individual seller and pay financial penalties like fine or other expenses, Tech Place can make some arrangements to get reimbursement for fine and expenses from the seller if caused by seller’s negligence.

Disputes with Tech Place

We are always ready to help you out if you have any issue with us. If we cannot help you out, there are some rules that will govern legal disputes.

1. Governing law

The law that governs the terms are the laws of the State of New York and laws of the United States of America. Any important point that needs to be considered here is that you will be abiding by these laws even if you are not living in the United States of America. However, your local consumer protection law will have the authority to give you protection under some provisions.

2. Arbitration

American Arbitration Association or in other words “AAA” under its Consumer Arbitration Rules or the AAA Rules, will administer all the disputes and legal proceedings. The Tech Place and consumer will consider the AAA as the final and binding arbitration unless otherwise required by law, as incorporated by reference into this section and as to the date of these terms as you find in AAA Rules. A sole arbitrator will be handling the threshold questions of arbitrability of disputes in accordance with the AAA rules. Combined actions or combined arbitration is not allowed as it can only be taken place on an individual basis and judgements can be entered in any court that has jurisdiction. Agreeing to the terms means both Tech Place and you are waiving the right of trial by jury or to conduct combined arbitration or combined actions.

If your claim qualifies, you can take these claims to “small claims” courts but they will remain in that court on an individual basis. Waiving the right to trial by jury still give you and Tech Place the right bring an action to the court of jurisdiction for relief, where the final decision will be pending by the arbitrator.

3. Cost of arbitration

The Consumer Arbitration Rules will decide that what should be the payment for a single or all AAA filings. This also includes arbitrator fees and administrative expense. It also depends on the amount of the claim that how payments will be made. For example, if you file AAA arbitration and the amount of your claim is under $10,000 USD, Tech Place will pay suitable filling, administrative and arbitrator fees. Tech Place will be free from paying any of these expenses if arbitrator feels that actuality of your claim is impractical and false.

4. Forum

Place of legal actions is very crucial. Tech Place is based in ______and if you are going to start any legal proceedings against Tech Place, these should be initiated in ¬¬¬¬¬¬¬_______. AAA Rules gives an opportunity that you can start legal actions in the place where you live if those actions fall under AAA Rules. For all hearings, the arbitrator will decide the suitable location for both parties according to their ability to reach at that location with convenience and by taking into account all possible circumstances. While filing the proceedings in a state or federal court, the location of the hearing will depend on your contact. If your contract is with Tech Place, Inc, the personal jurisdiction of state or federal court will be ¬¬¬¬______ and jurisdiction will be _________ if your contract is with Tech Place.

5. Exception for Governments

There are some exceptions if you are an agent for the Government or body in the United States. You may not legally agree to the clauses of the AAA Rules of the section and these rules will not be applicable on you if you are an entity as stated above and using the services in your official capacity. For such agents or Government officials, the terms and all the actions taken under the terms will be governed by the law of the United States. The law of State of New York will also be applicable if federal law does not exist and also if federal law allows to do so.
